Are lights, blink- ers, taillights required? If not legal, can I cross the road? Also, driving a 3 or 4 wheeler on a path or trail that may be pri- vate but is not marked. The type of vehicle you are talking about is known as an all terrain vehicle or ATV. I hope this answer will be of some help. I strongly recommend that you contact your local Conservation Officer for a more detailed answer. The laws pertaining to ATV's state certain restrictions depending upon the age of the operator, oper- ating under a safety certifi- cate or driver's license, and how the ATV is registered and used (recreational or agricultural). Some restric- tions apply to certain areas of Minnesota. It is also pos- sible that some counties, towns, or townships may have additional restrictions too. However, my answer will be very generic with the assumption that you are not a farmer conducting agricul- tural work but rather some- one who is a recreational ATV operator. First, Statute 84.928 says a person shall not operate an ATV on the roadway, shoulder, or inside slope of the ditch. Now it can be done if the driving conditions of the ditch are such that you can't use the bottom or outside slope. When operating in the bot- tom or outside slope at night you are to drive in the same direction as the highway vehicle traffic does. It also says that from April 1st to August 1st shall oper- ate an ATV within the high- way right of way (this includes the bottom and out- side slope of the ditch) with- in an agricultural zone unless the vehicle is used exclusively for agricultural work. Second, a headlight and taillight are required. If the ATV came with a brake light it must be in good working order. Third, cross- ing a road is allowed if the crossing is made at a 90- degree angle. You are required to stop fu'st and yield to highway traffic. If crossing a 4-lane highway you must do so at an inter- section. If you are operating under an ATV safety certifi- cate and not a driver's license there would be some other restrictions here also. Fourth, never operate an ATV on private property without the permission of landowner. If you have any ques- tions regarding traffic safety and or traffic law please write Sgt. Kathy Pederson at MN State Patrol, PO Box 344B, Marshall, MN 56258. Sgt. Pederson will not offer advice on specific situations or real events, which involve law enforcement.
